Poison Centres

The regulation concerning CLP (EC Regulation 1272/2008) was amended on 22 March 2017 when EU Commission Regulation 2017/542 was published. This long-anticipated piece of legislation added a new Annex (Annex VIII) to CLP on harmonised information relating to the provision of information for emergency health response.

The regulation describes the information required to be notified and also introduces a new requirement to print a Unique Formula Identifier (UFI) on mixture labels. The amendment regulation allows for the Unique Formula Identifier (UFI) to be added to either the mixture label or the mixture packaging.

Each Member State has nominated an appointed body that receives the information on the mixtures. The appointed body in many European countries is also the poison centre; where the appointed body is not the poison centre, they pass the information on to the relevant country poison centre.

The requirement to make notifications to appointed bodies and/or poison centres is for mixtures only. The information provided to the European Chemicals Agency (ECHA) under the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) is sufficient for substances.

The requirement to notify information on hazardous mixtures has existed for many years now, but up until Annex VIII was introduced each country had implemented its own requirements. The type of information and the format of the information vary from Member State to Member State. Annex VIII introduces a new harmonised format for notifications.

The deadline for industry to make notifications in the new harmonised format to the appointed body depends on the mixture use and as such there is a phased timeline for notification.

In January 2020, COMMISSION DELEGATED REGULATION (EU) 2020/11 amending Regulation (EC) No 1272/2008 of the European Parliament and of the Council on classification, labelling and packaging of substances and mixtures as regards information relating to emergency health response, was published. This amendment formally delayed the first deadline for consumer mixtures by a year, bringing it in line with the deadline for professional use mixtures. The dates are now;

  • Consumer and Professional use — 1 January 2021.
  • Industrial use — 1 January 2024.

For those who have already made notifications in accordance with Article 45(1) before the dates listed above, there is an extended deadline of the 1 January 2025 by which all existing notifications must be updated to the new requirements.
